On 6th April 2012 HM Government changed the Energy Performance of Buildings (Certificates and Inspections) (England and Wales) Regulations 2007.

The new Regulations apply to buildings put on the market on or after the 6th April 2012. There is no requirement to change the written particulars for buildings already on the market before this date.

From the 6th April 2012 when giving written particulars of all new instructions for sales, lettings and commercial properties an agent must provide access to either the whole front page of the new style EPC, or the entire document. The "fridge sticker" chart (see example below) will no longer be sufficient to fulfil the new legal requirement.

The new definition of "giving written particulars" includes making them available electronically, such as information on a website or in an email. A copy of the first page of the EPC must be attached in all cases as a minimum.

For sites with a data feed

You will need to either upload a file or provide a hyperlink to a file that has already been uploaded.

Your upload options are: -

1. Upload the PDF via your agency software OR

2. Upload the PDF via your web site.

Your software provider can tell you how, or if, they support uploading files OR we can provide access to your web site to upload the files.

Your hyperlink options are:-

1. Input the hyperlink into your agency software OR

2. Input the hyperlink into your web site. 

The hyperlink could be from the government's Landmark site, provided by an energy assessor or provided by your software provider but will only exist if you have already uploaded the PDF.

For sites using our Database

Displaying the new EPC

We will change the way the full property details page is displayed in such a way that the appearance of an EPC will be conditional upon the age of the instruction being displayed. If the old style "fridge sticker" is available and relevant because of the age of the instruction we will display that as at present.

However, our code will detect if there is a URL for the new style EPC and create a link for the visitor to click and download the PDF for it.

Please note that these new regulations apply to Apps and Mobile sites too.

Because each site is different and unique to our clients seamless integration of this into every site will require some bespoke work.

We do not wish to exploit the fact that changes are legally necessary to sites and have therefore taken the view that we will advise any client that wants us to make this change of the costs they will incur but in any event we will cap any charges to a maximum of £25 irrespective of how complex the work is.
